So much for power to the people.  Seems like it is power to the biggest corporations:

BitTorrent Case Judge Is a Former RIAA Lobbyist and Pirate Chaser

Less than a week after her investiture ceremony, U.S. District Court Judge Beryl Howell laid down a landmark verdict that will make it easy for copyright holders to send cash demands to people they suspect of copyright infringement. Many people called the decision into doubt, and the revelation that Judge Howell previously worked as an RIAA lobbyist and as the Managing Director of a pirate-chasing outfit hints at a conflict of interest.

Last week, the freshly appointed U.S. District Court Judge Beryl Howell gave copyright holders carte blanche to continue their profitable settlement schemes. This verdict weakens the position of thousands of alleged BitTorrent users, some of whom may be completely innocent.

Despite opposition from ISPs and consumer rights groups who described the tactics as “extortion,” Howell decided in favor of the copyright holders. An extremely unfortunate precedent to say the least, and this is confirmed by lawyer Robert Cashman who represents several defendants in similar cases.

The treatment of Bradley Manning can no longer safely be ignored; if mistreatment is allowed once, it will become the standard treatment for those who speak out.  Bruce Ackerman of Yale has drafted a statement that the legal community is being asked to sign and signing it they are:

A Statement on Private Manning’s Detention

Yochai Benkler and I invite members of the academic legal community to join us in signing the following statement, asking the Administration either publicly to justify, or end, the humiliation and mistreatment of Private Bradley Manning, the suspected whistleblower who is said to have leaked classified government documents to Wikileaks.

UPDATE:Our initial draft relied on news reports in the major news outlets. Comments we received since then lead us to think that two facts may be overstated in the original draft:
1. The instance of forced nudity overnight and in morning parade apparently occurred once. The continuing regime apparently commands removal of Pvt. Manning’s clothes and his wearing a “smock” at night.
2. The shackling apparently occurs when Private Manning is moved from his cell to the exercise room, but not while walking during the one hour of exercise.

Other responses we have received suggest that there are claims of myriad other abuses that make conditions worse in various ways than we describe. We do not, and cannot, seek to adjudicate these factual claims. The conflicting responses underscore the need for a public, transparent, and credible response to the reported abuse, and cessation of those among them that cannot be justified.

Private Manning’s Humiliation

Bradley Manning is the soldier charged with leaking U.S. government documents to Wikileaks.

He is currently detained under degrading and inhumane conditions that are illegal and immoral.

For nine months, Manning has been confined to his cell for 23 hours a day. During his one remaining hour, he can walk in circles in another room, with no other prisoners present. He is not allowed to doze off or relax during the day, but must answer the question “Are you OK?” verbally and in the affirmative every five minutes. At night, he is awakened to be asked again, “are you OK” every time he turns his back to the cell door or covers his head with a blanket so that the guards cannot see his face. During the past week he was forced to sleep naked and stand naked for inspection in front of his cell, and for the indefinite future must remove his clothes and wear a “smock” under claims of risk to himself that he disputes.

The sum of the treatment that has been widely reported is a violation of the Eighth Amendment’s prohibition of cruel and unusual punishment, and the Fifth Amendment’s guarantee against punishment without trial. If continued, it may well amount to a violation of the criminal statute against torture, defined as, among other things, “the administration or application… of… procedures calculated to disrupt profoundly the senses or the personality.”

Private Manning has been designated as an appropriate subject for both Maximum Security and Prevention of Injury (POI) detention. But he asserts that his administrative reports consistently describe him as a well-behaved prisoner who does not fit the requirements for Maximum Security detention. The Brig psychiatrist began recommending his removal from Prevention of Injury months ago. These claims have not been publicly contested. In an Orwellian twist, the spokesman for the brig commander refused to explain the forced nudity “because to discuss the details would be a violation of Manning’s privacy.”

The Administration has provided no evidence that Manning’s treatment reflects a concern for his own safety or that of other inmates. Unless and until it does so, there is only one reasonable inference: this pattern of degrading treatment aims either to deter future whistleblowers, or to force Manning to implicate Wikileaks founder Julian Assange in a conspiracy, or both.

If Manning is guilty of a crime, let him be tried, convicted, and punished according to law. But his treatment must be consistent with the Constitution and the Bill of Rights. There is no excuse for his degrading and inhumane pre-trial punishment. As the State Department’s PJ Crowly put it recently, they are “counterproductive and stupid.” And yet Crowley has now been forced to resign for speaking the plain truth.

The Wikileaks disclosures have touched every corner of the world. Now the whole world watches America and observes what it does; not what it says.

President Obama was once a professor of constitutional law, and entered the national stage as an eloquent moral leader. The question now, however, is whether his conduct as Commander in Chief meets fundamental standards of decency. He should not merely assert that Manning’s confinement is “appropriate and meet[s] our basic standards,” as he did recently. He should require the Pentagon publicly to document the grounds for its extraordinary actions –and immediately end those which cannot withstand the light of day.

Is this quote from:

The answer, as always, is “A”  And the report was given to a protestor in answer to a FOIA request, by accident.  It gives insight into the new thinking on the part of the government that equates dissent with terrorism and the exercise of First Amendment rights with criminality.  After the government released it, it then tried to cover up the existence of the report, but too late–here it is.  Covered by Will Potter at the ever-excellent blog Green is the New Red:

Richmond Cops Mistakenly Hand Over Anti-Protest Guides to Anarchist

After filing a Freedom of Information Act request with the Richmond Police Department for police training documents, Mo Karn received much more than expected in return: homeland security and crowd control guides that show how the police target protests.

The police filed for an emergency court order yesterday to prohibit Karn from publicizing any of the documents, which should never have been released. The cops’ reasoning? “Defendant Mo Karn is a known and admitted anarchist.”

The documents, however, have already been published online. And buried in the training guides are insights into three trends in law enforcement that have been occurring not just in Virginia, but nationally: the demonization of protest, the militarization of police, and turning local cops into “terrorism” officials.

The Demonization of Protest

The Richmond Police Department’s Emergency Operations Plan
includes a section on “civil disturbances.” While this sounds innocuous, “civil disturbances” are defined so broadly as to include what the police call “dissident gatherings.”

“The City of Richmond is a target rich environment” for antiwar protesters, the document says. And it warns that police and homeland security have reason to be increasingly concerned:

“Current training and intelligence reveals that protestors are becoming more proficient in the methods of assembly.”

Militarization of Local Police

Such a depiction of “assembly” (a First Amendment right) as a “disturbance” and a threat is all the more troubling when put in the context of the other police department guides. Richmond’s Crowd Management Operating Manual is for the police unit assigned to large protests (no experience required). Among the tools that the crowd management team are issued include riot shields, chemical agents, cut tools, helmets, body armor, cameras, video cameras, batons, gas masks, and a “mass arrest kit.”

Deputizing Local Cops as Counter-terrorism Officials

This militarization of local police is accompanied by another trend in law enforcement since September 11th: deputizing local cops to becoming “homeland security” and counter-terrorism officials. According to the Homeland Security Criminal Intelligence Unit Operating Manual, “The Richmond Police Department is under contract with the FBI to provide assistance through staffing, intelligence and equipment.” And one member of the homeland security unit is assigned to the Joint Terrorism Task Force.

The result? Documents like the Virginia Terrorism Threat Assessment. The 2009 document was created by the Virginia Fusion Center, of which the Richmond Police Department is part. Fusion centers are ostensibly designed to gather terrorism intelligence from multiple police agencies, and make us safer. In practice, they routinely label activists as “terrorists.” Among the “terrorist threats” identified in Virginia were animal rights activists, environmental activists, and anarchists.

It seems there is a meme out there that wikileaks founder Julian Assange should be hunted down and killed. This noise is being spouted by US right-wing hate groups, as well as some semi-mainstream press figures (although the difference between those two groups is getting paper thin), and they seem to forget that freedom of speech is, like, in the Constitution. I won’t link to any of the pundits that are out there brazenly advocating murder, except to make the very obvious comment that they are very evil, and if anything should happen to Julian, they would obviously bear a great deal of the responsibility and should therefore also bear some punishment if Julian were to be harmed. Of course I am only advocating legal punishment, not extra-judicial killing or anything like that. That would be wrong.

But before anyone goes out and kills Julian they should take note of how very popular he is. Look at the comments from the BBC sound-off board. Pro-wikileaks comments are running about 10 to 1. And I feel quit certain that of the 10% of the population that doesn’t like what wikileaks has done, the majority would not favor his extra-judicial killing.

So, think before you sic your goons on Julian.

Apparently, unknown entities have decided to take down the wikileaks website in advance of the publication of the State Department cables., scheduled for Monday to coincide with the publication in several newspapers of stories based on those cables. So, a DDOS attack is wrong, unless you are the government. No matter, wikileaks had of course foreseen this, and the actions of the US government are at once pathetic and arrogant.

How Two Civilian Sleuths Brought Foreclosure Problems to Light

Palm Beach, Forida – More than a year before lenders, law firms and document companies began owning up to widespread paperwork problems with their foreclosure filings, Lisa Epstein and Michael Redman already knew that something was wrong – very wrong.

Redman, a former online automobile consultant, got his first taste of the problem in early 2008, when he tried to help a relative who was facing foreclosure.

As he tried to determine which of three or four supposed lenders held the note, Redman, 35, realized that not only did he not know the answer, neither did any of the companies that were asking for payment.

Wikileaks has been the victim of several attempts by those who don’t like it to kill it.  First, there was Bank Julius Baer who tried to suppress it, but lost.  Then there was the raid by the German Police.  Then there were the allegations of rape by Julian Assange, soon proven to be false. We have the high point of the war against wikileaks: Marc Thiessen’s suggestion in the Op-Ed page of the Washington Post that Julian should be killed.  Then there was the smear campaign to imply that wikileaks was funded by the Chinese government.  Now, the U.S. Government has put wikileaks on a list that makes it difficult to make donations to them. There funding may be blocked, but not for long.  And when it is unblocked, there will be even more funding than there was before the blocking.

It is clear that the Golden Rule is operative: he who has the gold makes the rules.  Democracy doesn’t exist, the Free Market does not exist.   If you think wikileaks is doing a good job and want to support them: too bad, because they will destroy your freedom to vote with your dollars and give them money.  Never mind that you have no choice at the polls because because any candidate that stands for real change is shut out of any public forum and arrested.

Well, guess what.  We’re not gonna take take.  I will and have given money to wikileaks again and again and again. If I have to fly to Sweden with my donation in my carry-on luggage, that will be how wikileaks will get their donation from me.  The U.S. government cannot and will not stop me.

The cowards who are hiding behind these repressive and anti-democratic actions need to be exposed as the hypocrites that they are.

Insurance has a purpose, and a time.  I hope that time is soon. But, when wikileaks publishes its next round of leaks, we should remember all those who suffer everyday because of an unjust war, and hope that this release will bring end of the war closer, and the chances of the start of another war that much more remote. The mandatory focus in the mainstream media just after the last leak–the possible use of the data to orchestrate retaliations–is very odd when one considers there was nothing hypothetical about the war crimes documented in the first leak. Thousands of people were killed who shouldn’t have been. Maybe there should be more questions on the perpetrators, rather than those who have exposed the wrong-doing.
